This agreement applies as between you, the User of this Web Site and Thrive at University, the owner(s) of this Web Site. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Web Site. If you do not agree to be bound by these terms and conditions, you should stop using the Web Site immediately.

Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:

means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;

means collectively any online facilities, tools, services or information that Thrive at University makes available through the Web Site either now or in the future;

"System"

means any online communications infrastructure that Thrive at University makes available through the Web Site either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;

"Users"

means any third party that accesses the Web Site and is not employed by Thrive at University and acting in the course of their employment; and

"Web Site"

means the website that you are currently using (www. thriveatuniversity.com).

All Content included on the Web Site, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Thrive at University, our affiliates or other relevant third parties. By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other relevant laws.

You may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web Site or unless given express written permission to do so by Thrive at University.

Access to Courses and Coaching programmes

Unless otherwise specified, we grant you a non-exclusive, non-transferable, limited right to access, use and display our Website, Services, Courses and the Coaching that you subscribed to, for your personal, non-commercial use, provided that you comply fully with the provisions of this Agreement. You agree not to assign, transfer or sublicense your rights as a registered user of, or subscriber to, our Services. You understand that only you may use your user account and password and that your subscription to our Services is only valid for your personal, non-commercial use and may not be shared with others. You agree to be financially responsible for all usage or activity of our Website, Coaching, Courses and/or Services subscribed to by you. To subscribe to Courses or Coaching, you represent that you are a United Kingdom citizen or resident with a valid United Kingdom mailing address and that you are eighteen years or older or have the permission of your parents and have the right, capacity and authority to enter into and abide by these Terms and Conditions.

Terms of Use

Thrive at University accepts no liability for any disruption or non-availability of the Web Site resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

Thrive atUniversity encourages you to post your comments on its website where prompted and welcomes your feedback. For comments that do not comply with these Terms of Use we reserve the right to remove them. Thrive at University reserves the right to reproduce, publish and use any and all parts of any posting in any way it sees fit.

By accepting these Terms of Use you agree to not post any material that a reasonable person would consider:

  • As including any racial, sexual or other offensive, provocative or discriminatory language
  • Is inappropriate to discuss within a forum which has users under the age of 18
  • Is defamatory, abusive, harassing or hateful and capable of damaging the reputation of a person or organisation. If successfully sued you could be held liable for considerable damages and costs
  • That you do not have the necessary rights, licences and consents to post
  • Constitutes spam, unauthorised advertising or solicits
  • Infringes, dilutes, breaches, undermines or in any way constitutes unauthorised use of the intellectual property rights held by others including Thrive at University and its related organisations
  • Contains long embedded URLs
  • Invades anyone’s privacy or impersonates anyone
  • Is far off-topic as irrelevant posts lower the value of the debate for everyone and may be removed
  • Encourages conduct that may or would constitute a criminal offence or give rise to civil liability, or that otherwise violates any law
  • The comment appears to contain irrelevant or excessive links or appears to contain code
  • Personal information as it is unacceptable to publicise your or anyone else's contact details including address, place of employment, name of educational establishment, telephone or mobile number, email address, etc. This is for your own safety and that of everyone who uses this service
  • In a different language to English. Posts containing languages other than English may be removed. Common greetings and salutations in languages other than English may be acceptable
  • As raising your voice. The use of capital letters is considered as raising your voice in internet shorthand
  • As inappropriate usernames that are vulgar or offensive, etc

We will not edit comments to remove objectionable content, so please ensure that your posting contains none of the above to avoid it being removed.

Anyone posting a comment is deemed to accept use and publication thereof. Notwithstanding any moderation, Thrive at University cannot be held in any way responsible for the comments posted on the website. No reliance should be placed on any comments and nothing on this site should be seen as a substitute for formal advice. Thrive at University will be alerted to all comments posted on the site. Anyone who violates the Terms of Use may be blocked from making future comments.

Courses Cancellations & Refunds

By completing your registration and making a payment of full or instalment, you agree to the following Terms:

Under this refund policy and under guidance of the Consumer Contracts Regulations 2013, you may cancel your purchase of the course within the period of 14 calendar days (cancellation period) of receiving your order confirmation without giving any reason, you are entitled to a full refund of the price paid.For the avoidance of doubt, the cancellation period will expire 14 days after the date of the Order Confirmation.

If you choose to cancel within this period you will receive a refund of the price within 30 days if you are eligible for refunds.

If we posted any study material to you, you should return them to us before the refund.

Once a course has been redeemed, we cannot grant a refund. All refund requests can be sent to [email protected]

Any course cancelled after the cancellation period, is subject to an admin fee of 25% of the course price applies (which will not be refunded). The remaining deposit will be refunded. You need to request the cancellation at least 5 working days before the starting date.

You are not eligible for any refund if you made a request for cancellation less than 5 working days before the starting date.

We will make all reimbursements using the same means of payment as you used for the initial transaction.

You will not have the right to cancel a Contract where the Services have been fully performed.

Thrive at University reserves the right to cancel a course if number of delegates have not reached the minimum required to run the course effectively. The company also reserves the right to cancel in the event of an unforeseen circumstance which disables a safe training environment. In the event of a cancellation, Thrive at University will either arrange for an alternative course date or offer a full refund of the fee paid.

Coaching programme Charges, Cancellations & Refunds

Subject to receipt of the Charges by Thrive at University in full or in instalments we shall supply the coaching programme to you in accordance with the learning principles set out on our website from time to time.

Payment in full of the Charges shall be received by Thrive at University in cleared funds no later than 6 weeks before date of commencement of the Coaching programme, unless by prior written agreement with us.

Should the Charges not have been paid in accordance with the Contract you will not be permitted to commence the Coaching programme.

All amounts payable by you under the Contract are exclusive of amounts in respect of value added tax chargeable for the time being.

You may cancel the Agreement by notice in writing at any time up to 14 days after the application approval date. It is your responsibility to ensure and confirm that any notice of cancellation has been received by us and that you have received an acknowledgement of receipt from us. In the event of you cancelling we will retain any deposit paid but the balance of the Charges shall not be payable by you. In the event of you cancelling a coaching programme any deposit or Charges paid will be retained as outlined below.

In the event of your being unable to attend a coaching programme on the dates you originally booked we will use reasonable endeavours to accommodate requests for transfers to alternative dates or alternative coaching programme but shall be under no obligation to grant such requests. If it is not possible to arrange for you to attend an alternative coaching programme any deposit or Charges paid will be retained by us.

All coaching cancellations must be sent to us in writing by email to [email protected]. We cannot accept verbal course cancellations.

If booking is cancelled with less than 6 weeks’ notice of the start date, the deposit will be retained as a cancellation fee, unless you are able to transfer to another date in which case no cancellation fee will apply.

If booking is cancelled with less than 4 weeks’ notice of the start date, the full course balance will be retained as a cancellation fee.

Substitute delegates cannot be used, unless approved in writing by Thrive at University.

No Guarantees

When you chose to work us, attend one of Thrive at University`sCoaching programmes, or follow an online course, we are always be here to support you. Our role is to accompany and assist you in reaching your own goals, but your success depends primarily on your own effort, motivation, commitment and follow-through. We cannot predict and we do not guarantee that you will attain a particular result, and you accept and understand that results differ for each individual. Each individual’s results depend on his or her unique background, dedication, desire, motivation, actions, and numerous other factors. You fully agree that there are no guarantees as to the specific outcome or results You can expect from using the information you receive from us.Thrive at University assumes no responsibility for how you use any information, services, products or documents provided.

Limitation of Liability

To the maximum extent permitted by law, Thrive at University accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Web Site or any information contained therein. Users should be aware that they use the Web Site and its Content at their own risk.

Nothing in these terms and conditions excludes or restricts Thrive at University’s liability for death or personal injury resulting from any negligence or fraud on the part of Thrive at University.

Every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977. However, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.

No Waiver

In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

Previous Terms and Conditions

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

Notices

All notices / communications shall be given to us either by post to our Premises (see address above) or by email to [email protected]. Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.

Law and Jurisdiction

These terms and conditions and the relationship between you and Thrive at University shall be governed by and construed in accordance with the Law of England and Wales and Thrive at University and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
